Introduction

This policy governs your use of the Awqef Financial website and applications ("the Platform/Services"). By accessing or using the Services, you acknowledge that you have read and agreed to this policy.

Disclaimer

This is a technical usage document. Endowment products (such as the Endowment Portfolio, Donation of Proceeds, Temporary Endowment) have independent documents that are clarified and agreed upon when submitting a request for the product.

Who Are We?

Awqef Information Technology Company (a limited liability company), headquartered in Dammam, registered under Commercial Registration No. (2050170578), and authorized by the Capital Market Authority (CMA) within the Financial Technology (FinTech) Experiment to test the Robo-advisory service on 22/02/1446H, corresponding to 26/08/2024G.

Definitions

• User/Endower: Anyone who uses the Services or creates an account. • Services: The website, applications, interfaces, and digital features belonging to Awqef. • Endowment Product: Any product provided by Awqef (Endowment Portfolio/Donation of Proceeds/Temporary Endowment, etc.), the details of which are subject to its own specific document.

Account Creation, Authentication, and Verification

• The use of certain Services may require creating an account and providing correct and up-to-date information. • We may amend this Use Policy at any time without prejudice to applicable regulations, and after notifying users via email. The amendment becomes effective 10 days after notification, and your continued use of the Services constitutes acceptance of the amendments. • We may use regulatory verification methods and identity providers (OTP/Apple/Google) as we make available. • Accounts for minors may not be created except by the guardian and in accordance with regulations (if available within the relevant product). Awqef may establish a suitable portfolio for minors in compliance with applicable regulations. • The Platform has the right to suspend/terminate the account if there is suspicion of a violation of this policy or regulations, or if security risks exist.

Permitted Use and Prohibited Practices

Permitted: Using the Platform within the limits of its endowment investment purposes (including but not limited to): • Account management. • Creating/monitoring endowment products. • Viewing content. • Executing authorized operations. Prohibited (including but not limited to): • Violating the laws of the Kingdom, infringing on the rights of others/intellectual property, or violating public morals. • Publishing misleading/fraudulent/unauthorized advertising content or sending spam. • Attempting to hack, introducing malicious software, disrupting the service, or circumventing controls. • Collecting user data without explicit permission or misusing interfaces/bots/crawlers.

Risks and Acknowledgement

• Awqef operates according to a low-risk model focusing on cash/money market instruments and suitable securities as decided by internal policies and governing controls. • Although the model targets low risk, all investments carry a degree of risk, and full preservation of capital cannot be guaranteed under all economic conditions. • The Platform does not provide specific investment advice nor guarantee a specific return; returns vary according to market conditions and adopted policies. • The Platform's content is general and informative; you must refer to the Endowment Product documents before making any commitment. • The geographical scope of use is within the Kingdom of Saudi Arabia unless otherwise stated in the product documents or regulatory instructions.

User-Provided Content

• What you provide may be considered non-confidential (unless the interface states otherwise). • You retain your rights and grant us a limited, non-exclusive technical license to operate the Service (hosting/displaying/backup). • We may remove any content that violates this policy, regulations, or our professional values.

Intellectual Property

• All elements of the Platform (logos, identity, text, designs, code, media, policies, etc.) are protected and owned by us or our licensors. • You are permitted to print/download one personal non-commercial copy while maintaining copyright notices and not separating materials from their context. • It is prohibited (including but not limited to): To copy/modify/republish for commercial purposes, reverse engineer, disassemble, translate, or create derivative works from any part of the Platform's code, designs, or media, or use them for commercial purposes without prior written permission. • IP Infringement Notice: If you believe there is an infringement, please contact us at [info@awqef.com] including proof of right, the link to the material, and a statement verifying the accuracy of the report. We may remove content or restrict access to it at our discretion.

Privacy and Data Protection

• The collection and processing of your data is subject to the Privacy Policy (which is an independent document considered part of this policy by reference). • By using the Services, you acknowledge reading and agreeing to the Privacy Policy.

Links and Third Parties

• The Platform may contain links to third-party websites or resources for reference only; this does not imply endorsement, and we bear no responsibility for their content or practices. Your access to them is at your own risk. • Linking to the Platform: You may create a link to our homepage in a legal and fair manner that does not damage our reputation or suggest non-existent sponsorship or endorsement. • No Framing: You may not "frame" any part of the Platform on another site, nor create links to pages other than the homepage without prior written consent. We reserve the right to withdraw linking permission at any time.

Availability, Security, and Viruses

• We strive to provide an appropriate level of availability and protection, without guaranteeing that the Platform is free from errors, interruptions, or malicious software. • You are responsible for configuring your systems and using protection software. • In the event of any unauthorized access attempt to the Platform or execution of a Denial of Service (DoS) attack, the competent authorities will be notified immediately, and the user's right to access the Services will be suspended immediately, without prejudice to any other rights established by law.

No Reliance on Information

• The Platform's content is general information and not personalized Sharia/legal/investment advice. • We do not guarantee the accuracy/completeness/currency of all content nor its suitability for your needs, and you should consult a qualified professional when needed.

Compliance with Regulations

The user commits to complying with applicable regulations, including (but not limited to): • The Anti-Cybercrime Law. • The Anti-Money Laundering Law and its subsidiary regulations and instructions.

Limitation of Liability

• This policy does not exclude any liability that may not be excluded under the laws of the Kingdom. • To the extent permitted by law, we will not be liable for any indirect/consequential/special losses arising from or related to the use of the Platform or reliance on its content, including data damages, technical malfunctions, or malicious software.

Indemnification

The user agrees to indemnify us (and our employees and representatives) for any claims, losses, or costs (including reasonable attorney fees) arising from their violation of this policy or regulations, or their violation of the rights of others.

Updates to the Platform and Policy

• We may update the Platform's features and content without an obligation to immediately update all materials. • This policy may be amended; users will be notified via email. The amendment becomes effective 10 days after notification, and your continued use of the Services constitutes acceptance of the amendments.

Termination and Suspension

• We may suspend or terminate access to the Services immediately and without notice in case of violation or the existence of security/legal risks. • We may remove any violating content and take appropriate legal measures. • We may suspend/restrict access or hold funds under investigation if required by the Anti-Money Laundering and Combating the Financing of Terrorism Law, "Know Your Customer" (KYC) requirements, or requests from competent authorities.

Governing Law and Jurisdiction

This policy is governed by the laws of the Kingdom of Saudi Arabia, and jurisdiction lies with the competent courts in the city of Riyadh—unless the law decides otherwise.

Language

This policy was drafted in Arabic, and a translation may be provided for convenience; in case of conflict, the Arabic text shall prevail.
