Introduction
This Privacy Policy is an integral part of the Terms and Conditions, subject to all definitions and provisions contained therein, and shall be interpreted and enforced together as an integrated unit.
Article 1: Definition of Privacy Policy
Awqef Financial gives the highest priority to protecting personal information, which refers to data that may lead to identifying a person directly or indirectly, including but not limited to: First name, last name or family name, Saudi National ID number, addresses, phone number, and bank account number.
This policy clarifies the types of information Awqef Financial collects from Platform users, the mechanism and purpose of collection, the processing measures Awqef Financial takes regarding this information, as well as the user's rights regarding their stored information.
Please note that the Privacy Policy may change from time to time, so the user must review the Platform periodically.
The Privacy Policy is an integral part of this agreement.
Article 2: Personal Information to be Collected
Awqef Financial collects user information upon registration in accordance with the processing purpose, including personal information such as name, ID number, date of birth, financial information, employment information, and contact information.
Awqef Financial collects information directly from the user, or indirectly via third parties, organizations, and other parties.
Awqef Financial, or any third party it contracts with and authorizes, may conduct all inquiries deemed necessary to verify the information provided, including but not limited to: checking commercial databases or credit reports.
When visiting the Platform, Awqef Financial collects cookie information for statistical purposes and to improve the Platform's appeal, content, and functionality, not for user identification purposes. Awqef Financial is committed to all laws and regulations regarding data protection.
Article 3: Information Processing and Disclosure
The user grants full consent to Awqef Financial and authorizes it to use this information and make it available to companies or entities dealt with for the purposes of executing investment or endowment operations, and/or to payment service providers, to pay amounts due to users, such as: First name, family name, email, phone number, residence, personal ID, date of birth, nationality, investment amount, and International Bank Account Number (IBAN) or Bank Identifier Code (BIC).
This information is used to provide products and services. Sometimes, Awqef Financial shares user information with affiliates or service providers it deals with to ensure continuity of service provision, and uses it to communicate with the user.
Article 4: Purpose of Collecting and Processing Personal Information
Awqef Financial processes your personal data in accordance with the principles set out in the Saudi Personal Data Protection Law (PDPL) and its implementing regulations. This data may be used for the following purposes:
• Providing and improving financial products and services offered by the Company and developing the quality of the user experience.
• Compliance with legal and regulatory requirements issued by competent authorities, including the Capital Market Authority (CMA) and the Saudi Data & Artificial Intelligence Authority (SDAIA).
• Verifying client identity and managing their accounts and financial transactions.
• Enhancing information security and ensuring the safety and confidentiality of personal data.
• Executing services requested by the user, including investment recommendations, management of endowment and investment portfolios, and other services provided by the Company.
The user's use of the Company's services constitutes explicit consent to process their personal data to the extent necessary to provide those services. The data owner may withdraw their consent at any time according to relevant regulations; however, this withdrawal may lead to the inability to provide certain services or their suspension due to their direct link to the data being processed.
The user may be asked for data necessary to provide services and information in the following cases:
• Logging in and providing Awqef Financial with information about the user or their affiliate company, such as name, ID data, job title, and email.
• Requesting an endowment, donation, or using certain services available through the Platform.
• Providing additional information such as name, address, and bank details.
• Participating in surveys or studies to improve service.
Awqef Financial, its affiliates, and service providers are committed to information confidentiality, follow applicable data protection laws and regulations, and Awqef Financial periodically reviews and monitors service providers to verify their compliance with security and privacy standards.
Article 5: Cookies
Awqef Financial uses cookies for the following purposes:
• To make the Platform easier and better to use, and to tailor products and services to user requirements and needs.
• To collect anonymous user statistics to understand how visitors use the Platform and improve its structure and content.
This information cannot be used to identify the user personally, and the user can disable cookie features from browser settings.
Article 6: User Rights Regarding Personal Information
The user has the right to submit a request to Awqef Financial to exercise any of the following legal rights:
• Access their personal information stored with Awqef Financial.
• Obtain a copy of their personal information in a readable format.
• Correct or update their stored information.
• Destroy their information in accordance with relevant laws and regulations.
• Withdraw their consent for the use and processing of their personal information.
This is done by submitting a request to Awqef Financial via the Company's unified number, or via email to the Personal Data Protection Officer: info@awqaf.sa, or by raising a ticket from the user's registered account on the Platform.
Article 7: Personal Data Storage and Retention Period
• Awqef Financial stores your personal data on servers belonging to licensed cloud computing companies within the Kingdom of Saudi Arabia. Personal data is also archived in a secure environment subject to best practices and internal restrictions for protection.
• When storing personal data, Awqef Financial takes all reasonable steps to protect your personal data from misuse, loss, unauthorized access, modification, or disclosure.
• Your personal data will be stored for (10) ten years. This period is extended as long as retention is necessary to achieve the purpose for which it was collected, unless a longer retention period is required to comply with another law or for a legal purpose such as compliance with a judicial order, court ruling, or other mandatory instructions and regulations.
• Personal data is destroyed using secure methods such as shredding or degaussing, or data is anonymized to prevent re-identification of individuals and their data.
